Marketing: The facility may contact the resident/responsible party about health-related benefits and services the facility may provide.
Research: The facility will get permission and authorization from the resident/responsible party should the facility partake in research projects that will involve access to health information that identifies tha resident.

Occasionally, special circumstances may arise warranting the use and disclosure of health
information without resident authorization and in accordance with federal and state law including:
-Use and disclosures for public health purposes including: the control of disease; the reporting of 
  deaths; the reporting of abuse, neglect and exploitation.
-Audits, investigations, surveys and legal proceedings as they relate to the oversight of facility
  compliance with rules and regulations.
-Disclosures for law enforcement purposes as required by law and/or pursuant to a court order,
  subpoena, warrant or other administrative request.
-Disclosures to coroners, medical examiners and or funeral directors.
-The resident's health information may be disclosed for organ procurement, banking and
  transplantation in accordance with law.
-Resident information may be disclosed as authorized and to the extent required to comply with
  workers' compensation and/or other benefit programs for injury/illness related to work.
-If the resident was a member of the armed forces, the facility may be required to disclose health
  information to government agencies as it relates to national security and/or intelligence.
-The facility may disclose health information that does not personally identify the resident or
  reveal who the resident may be.
There may be other laws that provide greater protection to the resident's health information not listed here. The facility will abide by the most stringent requirements with relation to a resident's health information.

Resident rights
The resident/responsible party has the right to the following as mandated by law:
-Receive notice of protection policies and procedures for resident health information.
-Request and receive access to inspect and obtain a copy of health information in accordance with
  state and federal law. The request may be denied in limited situations.
-Request restrictions on the use and disclosure of health information. However, the facility has the
  right to accept or refuse to abide by the restriction requests as they relate to treatment, payment
  and health care operations. Any request should be in writing on forms provided by the facility.
-Request to amend health information. To request an amendment, complete and submit a medical
  record amendment/correction form to the privacy officer. The facility may deny amendments to
  information that: was not created by the facility (unless the entity that created the information is
  no longer available); is not part of the health information the facility maintains; the resident is not
  permitted to inspect and copy the health information; and/or the health information is accurate and
  complete.
-Acquire an accounting of certain disclosures. The facility will provide request forms as asked but
  is not required to disclose information as stated in federal/state law.
-Any prior authorizations may be revoked unless the purpose for which the consent was obtained
  has already been served.
-Request that health information is communicated in alternative locations and/or by alternate
  means. The resident/responsible party may submit a restriction on use/disclosure of medical
  information and/or confidential communication to the privacy officer. The facility will
  accommodate all reasonable requests.
